For instance, mediation involves a neutral third-party mediator who helps the parties reach a mutually beneficial agreement. Arbitration is similar to mediation, but the arbitrator makes a final decision that is binding on the parties. Neither involves the courtroom, where a judge makes a final decision.⁠
